By accessing or using Activly ("the Service"), you agree to be bound by these Terms of Service. If you don't agree, don't use the Service.

Account Registration

To use the Service, you must create an account. You're responsible for:

  • Providing accurate, current information
  • Maintaining the security of your account
  • All activities that occur under your account
  • Notifying us immediately of unauthorized access

You must be at least 16 years old to use the Service.

Acceptable Use

You agree NOT to:

  • Display false or misleading notifications
  • Use the Service for illegal purposes
  • Spam, harass, or harm other users
  • Reverse engineer or attempt to extract our source code
  • Overload our servers or interfere with the Service
  • Resell or redistribute the Service without permission

We reserve the right to suspend or terminate accounts that violate these terms.

Subscription & Payment

Billing

Subscriptions are billed monthly or annually in advance. You authorize us to charge your payment method automatically.

Free Trial

New users get a 14-day free trial. Your card won't be charged during the trial. If you don't cancel before it ends, you'll be billed for your chosen plan.

Refunds

We offer a 30-day money-back guarantee. If you're not satisfied, request a refund within 30 days of your first payment.

Cancellation

You can cancel anytime from your dashboard. Cancellations take effect at the end of your current billing period. No partial refunds for unused time.

Intellectual Property

All content, code, designs, and trademarks are owned by Activly or its licensors. You may not copy, modify, or distribute any part of the Service without permission.

Your data (notifications, analytics) remains yours. We don't claim ownership.

Service Availability

We strive for 99.9% uptime but don't guarantee the Service will be error-free or uninterrupted. We're not liable for:

  • Downtime due to maintenance, updates, or technical issues
  • Third-party service failures (hosting, payment processors)
  • Data loss (though we back up regularly)

Limitation of Liability

To the maximum extent permitted by law, Activly is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the last 12 months.

Indemnification

You agree to indemnify and hold Activly harmless from claims arising from your use of the Service, violation of these terms, or infringement of any rights.

Changes to These Terms

We may update these terms from time to time. If we make significant changes, we'll notify you via email or a notice on the Service. Continued use after changes means you accept the new terms.

Termination

We may suspend or terminate your account if you violate these terms. Upon termination, your access ends immediately, and we may delete your data after 30 days.

Governing Law

These terms are governed by the laws of Delaware, USA. Any disputes will be resolved in the courts of Delaware.
